Terms & Conditions

These Terms govern your use of AcreWorks, operated by Nick McFerren as a sole proprietor ("we", "us", or "our"). By accessing or using the Service you agree to these Terms.

1. The Service

AcreWorks provides online calculators, market data, learning resources, and an optional "Pro" subscription with saved calculations, PDF export, multi-scenario compare, and an ad-free experience. You must be of legal age in your jurisdiction to enter into these Terms, and you must provide accurate information when creating an account.

2. Acceptable use

You agree not to misuse the Service, including by:

  • using it for any unlawful, fraudulent, or deceptive purpose;
  • infringing the intellectual property or privacy rights of others;
  • interfering with the security or integrity of the Service (e.g., malware, probing, scraping, denial of service);
  • attempting to access accounts, systems, or data you are not authorized to access.

3. Accounts and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized access.

4. Intellectual property

We retain all right, title, and interest in the Service, including all software, calculators, formulas, content, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your own internal business or personal use. You may not reverse engineer, resell, redistribute, or circumvent technical limits of the Service.

5. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

Pro subscriptions are billed in advance on a recurring monthly or annual basis and renew automatically until cancelled. You may cancel at any time through paddle.net or your AcreWorks account; on cancellation you retain Pro access through the end of the current billing period.

7. Calculator results — no professional advice

AcreWorks calculators and market data are provided for general informational and educational purposes only. They are not financial, investment, tax, legal, agronomic, or engineering advice and should not be relied on as a substitute for the judgment of a qualified professional. Decisions you make based on the Service are your sole responsibility.

8. Service level

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or loss of goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud, death, or personal injury caused by negligence).

10. Indemnification

You agree to indemnify and hold harmless Nick McFerren / AcreWorks from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

11. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; you may export any saved calculations during the 30 days following termination, after which they may be deleted.

12. Changes to the Service or these Terms

We may update the Service and these Terms from time to time. Material changes will be communicated on the Service or by email; continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the United States and the state in which the sole proprietor resides, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts of that jurisdiction.

14. Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

15. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, internet or hosting outages, or government action.
